What is Premises Liability?

Premises liability is a legal concept that is most frequently associated with personal injury cases where an injury was caused by unsafe or defective conditions on someone’s property.

In general, there are three factors in proving a premises liability case:

  • The property’s condition was dangerous
  • The owner knew (or should have known) that the condition was dangerous
  • The owner had a reasonable opportunity to correct or warn of the condition, which was not reasonably open and obvious to the injured party at the time of the accident

In other words, the injured person must prove that the property owner was negligent regarding ownership and maintenance of the property.
